6 Suspects Charged Over Ksh348 Million Corruption Case

The Ethics and Anti-Corruption Commission (EACC) has arraigned six suspects in connection with the alleged irregular award of a multi-million-shilling tender for the construction of the Homa Bay County Assembly office block.

In a statement on Tuesday, January 20, EACC said the 6 suspects were arraigned before the Kisii Chief Magistrates Court.

The suspects include Faith Adhiambo Apuko, the former Clerk of the Homa Bay County Assembly; Roseline Anyango Odhiambo, the former CEC for Lands in the Homa Bay County Government; Patrick Tonui, a former Quantity Surveyor at the Ministry of Public Works and Project Manager; and James Mumali Oyukah and Mary Pauline Oduor, directors of Hartland Enterprises Limited.

The 6 suspects are alleged to have been involved in the irregular award valued at Ksh 348 million to Hartland Enterprises Limited during the 2019/2020 Financial Year.

The accused, who appeared before Chief Magistrate, Hon. A. M. Obura, pleaded not guilty to the charges preferred against them.

The court granted each accused person a cash bail of KSh 5 million or an alternative bond of KSh 30 million with a surety of a similar amount.

The matter will be mentioned on February 2, 2026.

This comes days after the Director of Public Prosecutions (DPP) Renson Ingonga ordered the 6 suspects to be charged.

In a statement, the ODPP said the directive was issued after reviewing an inquiry file submitted by the Ethics and Anti-Corruption Commission (EACC).

“Investigations revealed that the former Clerk of the Homa Bay County Assembly, Mr Odhiambo Daniel Kaudo, alongside five other senior county officials, were allegedly involved in irregular procurement processes during the award of Tender No. HBCA/T/W6/2018–2019 for the proposed construction of the Homa Bay County Assembly office block.

“The tender was reportedly awarded to a company linked to employees of the County Government, raising serious concerns of conflict of interest, abuse of office, and violations of procurement laws,” ODPP stated.
