Court Suspends IEBC’s Sanctions Against David Gikaria

High Court has issued temporary orders suspending sanctions imposed by the Independent Electoral and Boundaries Commission (IEBC) on Nakuru East Member of Parliament David Gikaria.

Justice Wilfrida Musyoka issued the orders on Wednesday, July 15, following a petition filed by Gikaria through his lawyer Adrian Kamotho.

The High Court judge directed Gikaria to serve court papers on the IEBC and the enforcement committee within seven days.

The respondents, on the other hand, were also ordered to file and serve their responses once they receive the application.

“Pending the hearing and determination of the case, the court granted interim orders staying the implementation of the Electoral Code of Conduct Enforcement Committee’s decision delivered on July 14, 2026,” reads the order in part.

On Tuesday, IEBC slapped Gikaria with a Ksh2.5 million fine over remarks he made on voter handouts in Ol Kalou.

The Nakuru East MP was also directed to issue a public apology on Wednesday, July 15, at 10 am at Anniversary Towers in Nairobi CBD.

“Gikaria shall issue a public retraction and apology on Wednesday, 15th July 2026, at 10 a.m. at Anniversary Towers before the public and to the people of Ol Kalou and the country, undertaking that that was wrong and that it shall not be repeated,” committee chairperson Alutalala Mukhwana said.

Further, IEBC directed that the evidence presented before the committee be forwarded to the Office of the Director of Public Prosecutions (ODPP) for investigations into possible offences under the Elections Offences Act.

This comes days after  Kipipiri MP Wanjiku Muhia was granted court orders suspending the enforcement of a Ksh1.5 million fine issued by IEBC.
