The Senate has impeached Deputy President Rigathi Gachagua after a two-day hearing exercise.
In a vote held on Thursday, October 17, Senators voted on each of the eleven allegations levelled against Gachagua.
In the first count of gross violation of articles 10, 27, 73, 75, and 129 of the Constitution, 54 senators voted in favor while only 13 senators voted against.
In the second charge of Gross Violation of Articles 147 (1) and 152 (1) of the Constitution, 28 senators voted yes while 39 voted no.
On Gross Violation Of Articles 6 (2), 10 (2) (A), 174, 186 (1), 189 (1), And The Fourth Schedule Of The Constitution (Undermining Devolution) 19 senators supported the charge while 45 were against it.
The fourth charge of gross violation of Article 160 of the Constitution, undermining the institutional and decision-making independence of the judiciary, was supported by 51 senators, while 16 voted against it.
The fifth count of Gross Violation Of Articles 3 (1) And 148 (5) (A) Of The Constitution (Breach Of The Oaths Of Office And Allegiance) was supported by 49 senators while 16 were against it.
The sixth ground to believe that Gachagua committed offenses under sections 13 (1) (a) and 62 of the National Cohesion and Integration Act was supported by 48 senators, while 18 voted against and one abstained.
On the count of Serious Reasons To Believe That His Excellency Rigathi Gachagua Has Committed Crimes Under Sections 45 (1), 46, 47a (3), And 48 (1) Of The Anticorruption And Economic Crimes Act And Sections 2, 3, 4, And 7 Of The Proceeds Of Crime And Anti-Money Laundering Act, 13 senators voted Yes while 53 voted No.
The eight-count of Serious Reasons To Believe That His Excellency Rigathi Gachagua Has Committed Crimes Under Section 132 Of The Penal Code And Section 29 Of The Leadership And Integrity Act was supported by 27 senators while 40 were against it.
Ground nine of gross misconduct, relating to public attacks on the National Intelligence Service and its officers, was supported by 46 senators, while 20 voted against and one abstained.
Ground ten of gross misconduct touching on insubordination was supported by 22 senators and opposed by 45 others.
The final ground of gross misconduct involving harassment was supported by 18 senators, opposed by 47, and two others abstained.
Gachagua now becomes the first deputy president in Kenya to be removed from office under the revised constitution since 2010, preventing him from holding public office in the future.
