A university student was on Monday arraigned at the Milimani Law Courts on Monday for sharing an image of a funeral procession with misleading captions.
In a statement, the Office of the Director of Public Prosecution (ODPP) said the student David Oaga Mokaya alias Landlord posted the picture on November 13, 2024.
“A University student was today charged at the Milimani Law Courts with publishing false information by posting an image of a funeral procession featuring a casket covered with the Kenyan flag escorted by military officers in ceremonial uniform.
“The court heard that David Oaga Mokaya shared the said image on his X account, “Landlord @bozgabi ,” with the caption suggesting it showed President William Ruto’s body being transported,” read the statement in part.
According to ODPP, the accused person fabricated the date to make the post appear authentic. The offense is said to have been committed at an unknown location within the Republic of Kenya.
Appearing before Senior Principal Magistrate Benmark Ekhumbi, David Oaga Mokaya pleaded not guilty to the charges.
During the hearing, the prosecution stressed the seriousness of the offense, which violates laws aimed at preventing the spread of disinformation and maintaining public order.
The court granted Mokaya a KSh 100,000 bond or a cash bail of KSh 50,000. The case will be mentioned on December 4, 2024.
“Mokaya pleaded not guilty to the charges before Senior Principal Magistrate Benmark Ekhumbi. The court granted the accused person a bond of KSh 100,000 with an alternative cash bail of KSh 50,000. The case is scheduled for mention on December 4, 2024,” ODPP added.
