The High Court has suspended the enforcement of a Ksh1.5 million penalty imposed on Kipipiri Member of Parliament Wanjiku Muhia by the Independent Electoral and Boundaries Commission (IEBC).
Justice Nabil Mokaya Orina issued the interim orders on Monday pending the hearing and determination of Muhia’s application challenging the decision by the commission.
“That in the meantime, pending the hearing and determination of the application, an order is hereby issued staying the judgment/determination of the 2nd Respondent issued on 10 July 2026,” the court ordered.
The case will be mentioned on Monday, July 20, 2026, when the court will issue further directions.
On Friday, IEBC’s Committee on the Electoral Code of Conduct Enforcement slapped Muhia with a Ksh1.5 million fine over her controversial comments during a rally in Ol Kalou.
IEBC Commissioner Moses Mukhwana explained that the committee established that Muhia had violated Paragraph 6 (a) of the Elections Code of Conduct.
“The Committee hereby condemns and directs Hon Wanjiku Muhia to pay a fine of Ksh 1.5 million to the IEBC within 72 Hours of this judgment,” Mukhwana announced.
The committee further cautioned the DCP-allied MP against repeating such remarks, stating that they had the potential to incite violence, hatred, hostility and intimidation, and could undermine peaceful electoral campaigns.
“The Committee issues a stern warning to Hon Wanjiku Muhia that failure to comply with the orders issued herein or any subsequent violation of the Electoral Code of Conduct shall attract further sanctions, including, but not limited to, issuing an order barring her from contesting in any further election conducted by the IEBC in accordance with the applicable law,” IEBC added.
However, Muhia moved to the High Court to challenge the ruling, arguing that it was unlawful and should not be enforced until the court determines it.
